Booking Conditions
Read this agreement thoroughly and carefully before booking a tour with us. It is a legally binding contract that, together with our Privacy Policy and Website Terms of Use, and the attached Traveler’s Code, sets out our respective rights and obligations.
1. Booking Contract
In these Booking Conditions, references to “traveler,” “you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.
All bookings are made with DETOURS WITH DURSO LLC, a California limited liability company (“Detours With Durso,” “we” or “us”).
When you book any tour with Detours With Durso, you acknowledge that you have read these Booking Conditions, the Privacy Policy and Website Terms of Use, understand them, accept and agree to be bound by them.
If you book any Detours With Durso tour with more than one traveler named on the booking, you will be deemed to have accepted these terms and conditions on behalf of all travelers named in the booking. In doing so, you accept financial responsibility for the booking on behalf of all persons included on the booking
Further, by making a booking, you agree that you and all travelers named in the booking:

Are over 25 years of age for tours marketed on the Detours With Durso website, subject to exception based on the sole and express discretion of Detours With Durso, and with exception for private and custom tours;

Appreciate and accept the risks involved in adventure travel;

Do not suffer from any pre-existing medical condition or disability that may prevent active participation in the tour (if any person suffers from any medical condition or disability that will or may affect their tour arrangements, please contact us before making your booking so that we can advise as to the suitability of your chosen arrangements);

Consent to our use of personal data in accordance with our Privacy Policy, and that you are authorized on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (for example, information on health conditions, disabilities, dietary requirements).
2. Traveler Information
So that we may confirm your travel arrangements, you must provide all requested details at the time of booking and beyond. Necessary details include full name (as shown on your passport), date of birth, nationality, and any pre-existing medical conditions or allergies you have that may affect your ability to participate in the tour. We may also request a copy of your passport before and during the tour.
The information required from each traveler may vary by tour; this will be communicated during the booking process. If all requested information is not provided within 30 days of the tour start date (or at the time of booking if purchased less than 30 days prior to the tour start date), Detours With Durso maintains the right to cancel your tour without refund and assign your spot to the next eligible traveler on the wait list.
You must provide accurate information to us. We will not be held responsible for any problems or additional costs that may arise from any inaccurate or incomplete information that you provide.
3. Travel Documents
It is your responsibility to check and fulfill the passport or visa requirements and health requirements applicable to your itinerary. You must check requirements for your own specific circumstances with the relevant embassies and/or consulates and your own doctor, as applicable. Requirements do change and you must check for up-to-date information within a reasonable time before departure. If a traveler is unable to obtain travel documents or is prohibited from entering the destination country, our standard cancellation policy will apply.
We do not accept any responsibility if you cannot travel, or incur any other loss because you have not complied with any passport requirements or health formalities. You agree to reimburse Detours With Durso in relation to any fines or other losses that we incur as a result of your failure to comply with any passport or visa requirements or health formalities.
4. Fitness For Tour, Medical Conditions & Special Requirements
By booking with us, you represent that you do not have any physical or other condition that would create a hazard for you or other travelers, or affect other travelers’ enjoyment of the tour. Detours With Durso cannot guarantee the condition or availability of medical facilities in the countries in which we conduct our tours, some of which may involve visiting remote or less-developed regions. It is each traveler’s responsibility to consult with their physician regarding any medical conditions before booking a Detours With Durso tour. In addition, each traveler is required to bring sufficient medicine, allergy medications (e.g., EpiPen), and any necessary medical equipment.
Detours With Durso is committed to accommodating travelers’ special needs, including dietary restrictions or preferences; however, Detours With Durso cannot guarantee that it will be able accommodate or fulfill all such requests and is not liable to you for any failure to do so. We recognize that some guests may have severe food allergies. We make every effort to ensure that our suppliers are notified and prepared, but cannot guarantee that all requests will be accommodated.
If you have a medical condition or disability that may impact your active participation in a Detours With Durso tour, please tell us in advance of booking so that we may assist you in considering the suitability of the proposed tour. At the time of booking, you must provide full details of any such medical condition or disability; and you must update us if and when any change in your condition or disability occurs before or during the tour.
We may require a medical certificate with a doctor’s confirmation that you are fit to participate in your chosen tour. If we are unable to accommodate your needs, or for your own and others’ safety if we determine that you are incapable of meeting the tour’s demands, in our sole discretion reasonably applied, we reserve the right to decline your booking or to remove any traveler from a tour (at or before departure, or during the tour). Any costs resulting from being declined participation in a tour, or from being removed from a tour, will be borne by the traveler and are subject to our cancellation policy.
5. Booking Confirmation
Your booking is not finalized until you receive a confirmation email. For bookings made via our website, any acknowledgement of your booking request that we send to you in the meantime is not a confirmation of your booking.
We reserve the right to decline any booking at our sole and absolute discretion.
We will communicate with you by email. You must check your email account on a regular basis. We may also contact you by telephone if we cannot, for whatever reason, contact you by email. You should contact us by email if you need to do so for any of the reasons mentioned in these booking conditions. All emails should be sent to info@detourswithdurso.com.
Please refer to your booking confirmation invoice for details regarding final payments. For all tours, payment of the balance is due 45 days before the departure date.
We reserve the right to treat any reservation that is not fully paid according to the booking and payment terms as a cancellation and subject to the cancellation terms below.
6. Late Bookings
We emphasize the importance of making a booking at the earliest opportunity because of the small group nature of our tours.
For bookings received within 6 weeks of the start of your tour (or at an earlier stage for certain tours): (a) we reserve the right to pass on any extra costs incurred due to the late nature of the booking, and we will advise you of such additional costs when you make your booking; (b) the contract between us comes into existence as soon as full payment has been collected by us.
If you make a late booking or an “on request” booking, we strongly recommend that you do not book any flights or make other arrangements in connection with your chosen tour until you have received written confirmation of availability from us. If you choose to book flights or make any other arrangements before receiving written confirmation of availability from us, and your chosen booking is not available, we have no liability to you for any refunds or such costs incurred.
7. Waitlist
If a tour is sold out, you may add yourself to the waitlist during the booking process. If a spot becomes available, we will notify you by email. You will have 48 hours from when we send the email to accept the spot and pay the deposit; otherwise, we will offer the spot to the next person on the waitlist. We reserve the right to shorten the response time required, and so indicate in the email, if the departure date is fast approaching.
8. Tour Information & Pricing
Prices on Detours With Durso’s website and invoices are shown in USD per person, are based on double occupancy, and include taxes. Travelers who wish to have their own room will be charged a single supplement. This supplement varies depending on the tour and can be found on each individual tour page on our website.
There is no price adjustment offered for travelers arriving late or departing early from a tour.
We make every effort to ensure that all information and prices on our website and in any marketing material that we publish are accurate; however, occasionally changes and errors occur, and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to tour arrangements before you make your booking.
9. Deposit Requirements
You are required to pay a non-refundable deposit before Detours With Durso will review and confirm your booking request. The deposit amount is specific to each tour, and is provided on the tour booking page or otherwise identified on the website. If, for whatever reason, Detours With Durso, in its sole discretion, decides not to approve your booking, your deposit will be refunded in full. Regardless of the deposit amount, you will be required to follow the payment schedule set forth in the following section.
10. Payment & Schedule Requirements
If you chose to pay for your tour in installments, you will be required to follow the following payment schedule:

Initial deposit – 20% of tour cost due, or $500, whichever is greater

45 days before tour – 100% of tour cost due

Late payment – if final payment is not timely received 45 days before the tour, a late fee of $150 will apply and your reservation is subject to cancellation
Payment must be made in USD and can be made by debit card, credit card, or wire transfer. We do not accept cash. A 3% service fee will be applied to payments made by debit or credit card; if you prefer to pay by wire transfer (with no additional fees), Detours With Durso will provide wiring instructions with the confirmation email.
Detours With Durso is not responsible for any charges levied or charged by third parties and/or financial institutions as a result of credit card or other payment transactions related to the purchase of Detours With Durso tours. Those fees are your responsibility; we will not refund or return those fees.
If you fail to make a payment by the payment due date, we are entitled in our discretion to treat the missed payment as a breach of contract, cancel your reservation, and impose the cancellation fees specified in this agreement. We also retain the right to assign your spot to the next eligible traveler on the waitlist and, if we do so, you will remain subject to the specified cancellation fees.
11. Traveler’s Cancellation, Change or Transfer of Booking
The cancellation and trip-change policies outlined below take into consideration the costs Detours With Durso incurs long before the tour departs. Detours With Durso strictly adheres to the following policies.
Full Cancellation: A cancellation will only be effective when we receive written confirmation of the cancellation. We incur costs in canceling your arrangements. Therefore, if you or any member of your party cancels a tour, you will be responsible for the below amounts according to when you give us written confirmation of cancellation.

45 days or less before departure – no refund is possible
-
46-90 or more days before departure – deposit is retained by Detours With Durso.
Depending on the reason for cancellation, you may be able to reclaim the cancellation charges (less any applicable expenses) under the terms of your insurance policy. All claims must be made directly to the insurance company.
Change of Booking: If you wish to change any part of your booking after we issue our email confirmation, there will be a $100 admin fee for changes in addition to any additional costs or charges incurred by us or incurred and imposed by any of our suppliers will be charged, up to 45 days before departure; thereafter, all changes will be treated as cancellations and subject to the charges above.
Transfer of Booking: If you or any member of your party is prevented from traveling, that person(s) may transfer their place to someone else, subject to the following conditions: (a) that person is introduced by you and satisfies all the conditions applicable to the tour; (b) you notify us at least 7 days before departure; (c) you pay any outstanding balance payment, an amendment fee of $100 per person transferring, as well as any additional fees, charges or costs arising from the transfer; and (d) the transferee agrees to these booking conditions and all other terms of the contract between us. You and the transferee remain jointly and severally liable for payment of all sums. If you are unable to find a replacement, cancellation charges as set out above will apply in order to cover our estimated costs. Otherwise, no refunds will be given for passengers not traveling or for unused services.
Cutting Your Tour Short: No refund can be made if a traveler fails to join a tour, joins after departure, chooses not to participate in a particular activity, or leaves before its completion. If you are forced to return home early, we cannot refund the cost of any travel arrangements that you have not used. If you cut short your participation in the tour for circumstances about which you have no reasonable cause for complaint about the standard of accommodation and services provided, we will not offer you any refund for that part of the tour not completed, neither will we be liable for any associated costs you may incur. Depending upon the circumstances, your travel insurance may provide coverage and we suggest that any claims be made directly with your travel insurer.
Applicable to all paragraphs in this Section: There are no exceptions to this cancellation and refund policy, including for reasons related to (a) personal, family or medical emergencies, (2) weather, terrorism, civil strife, airline default, strikes not within the Force Majeure clause below, or (3) any other circumstances beyond our control. For this reason, we require you to secure travel insurance in order to participate on a tour.
12. Cancellation & Changes By Detours With Durso
Detours With Durso reserves the right to cancel a tour at any time up to 45 days before departure for international tours and up to 15 days for tours within the United States. We also reserve the right to cancel, alter or postpone a tour without prior notice at any time before departure or after a tour commences for the safety and/or comfort of travelers, or if is not viable for us to operate the planned itinerary, and for circumstances of Force Majeure (discussed in the section below).
If we cancel your tour for reasons other than Force Majeure, you may transfer amounts paid to an alternate departure date or receive a full refund. We are not responsible for any incidental expenses that you may have incurred as a result of your booking, including but not limited to visas, vaccinations, travel insurance, lodging, excess or non-refundable flights. Please refer to your required travel insurance policy for further details regarding expenses covered by your insurance carrier.
You understand and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each tour is representative of the types of activities that will be included but it is not a guarantee. While Detours With Durso will do its best to operate all tours as advertised, reasonable changes in the itinerary may be made where deemed necessary by Detours With Durso in its sole discretion. The route, schedules, itineraries, amenities, restaurants, hotels, and mode of transport may be subject to alteration without prior notice due to availability issues, local circumstances, weather, or other unpredictable and unforeseen circumstances beyond our control.
We shall not be deemed to be in breach of this agreement or otherwise liable to you, by reason of delay in performance, or by non-performance, of any of our obligations hereunder as a result of any cancellations, alterations or modifications under this section.
If we make an insignificant change to your tour, we will make reasonable efforts to inform you as soon as reasonably possible if there is time before your departure. Examples of insignificant changes include change of accommodation to another of the same or higher standard, or minor modifications to the itinerary based on local events or venue availability.
Occasionally, we may have to make a significant change to your confirmed arrangements. Examples of significant changes include a change of accommodation to that of a lower standard or classification for the whole or a significant part of your time away, or a significant change to the itinerary missing out on one or more key destinations entirely.
Any changes may require a supplemental payment from you or result in a refund less any cancellation fees and nonrefundable deposits. If we cancel, which is rare, a check for a full refund will be issued to you less any nonrefundable deposits advanced to local suppliers and any other third party cancellation charges. This refund will constitute full settlement of claims you may have arising out of our cancellation.
13. Force Majeure
Detours With Durso will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of nature and/or God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, pandemics, epidemics, diseases and viruses that are known, unknown or novel such as coronavirus/COVID-19 (including any spread thereof), government intervention of any kind including those that prevent domestic and/or international travel, border closings, border limitations, border restrictions, weather conditions, and other unforeseen circumstances. Regarding civil unrest, once we have investigated the prevailing situation, as we deem fit, it shall remain in our sole and absolute discretion whether to proceed with the tour.
If Force Majeure prevents, significantly hinders, or makes it impossible for us or our third-party suppliers to provide the anticipated services for or in any way related to your tour, we and our suppliers shall be entitled to, and may in our complete and sole discretion, vary, delay, postpone, alter or cancel any itinerary or arrangement in relation to the tour, including the entire tour itself.
No refunds under this section will be provided due to cancellations or changes due to Force Majeure, although we may, in our sole discretion, use reasonable endeavors to reimburse you where possible less the reasonable actual and potential costs to Detours With Durso of the Force Majeure. We may give you a travel voucher with certain terms and restrictions that can be used to book one of our tours, or we may rebook you on another departure within 18 months of your original departure date, in our complete and sole discretion depending upon the circumstances presented.
If we are affected by Force Majeure, if practicable, we will notify you of the nature and extent thereof.
14. Inclusions & Exclusions
The transportation, accommodations, activities, meals, and drinks provided by Detours With Durso are specific to each tour, and are listed on the tour booking page. Anything not expressly listed as included with the tour booking are not covered by Detours With Durso and are the financial responsibility of each traveler. We are not liable for expenses including meals, transportation, or hotel costs that are not specified as included in the trip cost but may be required to get to or from a trip start or end. In addition, our tours do not include international flights (unless specifically stated in the itinerary), visa and passport fees, vaccinations, travel insurance, optional activities, or other personal expenses.
15. Optional Activities & Supplemental Charges
Detours With Durso may offer optional supplemental charges (e.g., single room upgrade), which are specific to each tour. We will review all optional supplemental requests, and will provide final approval once we confirm availability.
In addition, we and our tour leaders may provide you with information (before departure and/or during the tour) about optional activities and excursions that do not form part of your pre-booked tour arrangements but which are available in the area you are visiting. Any prices given in advance are estimates only. We will not be liable if you cannot, for whatever reason, book any such activity or excursion or if the activity or excursion does not operate as advertised by the local operators or other providers. Any such activities are excursions are not run, supervised or controlled by us in any way; they are provided by local operators or other providers who are entirely independent of us and they may or may not have their own public liability insurance.
You accept that any assistance given by your group leader or local representative in arranging optional activities and excursions does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider. Any such activities and excursions do not form any part of your contract with Detours With Durso, even where we suggest particular operators or providers and/or where we assist you in booking such activities or excursions. We cannot accept any liability on any basis in relation to such activities or excursions.
16. Passports & Other Travel Documentation
You must carry a valid passport and have obtained all of the required visas, permits, certificates, proof of vaccinations, and other travel documentation for all countries you will visit during your tour. Your passport must be valid for 6 months beyond the tour return date. It is your responsibility to ensure that you satisfy all entry requirements and that you are in possession of the correct visas, permits and certificates for your tour and that all of the information on those documents are accurate. We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.
It is your responsibility to know of any health requirements for your destination, including but not limited to vaccinations and COVID-19 testing.
You are solely responsible for any adverse consequences, including additional costs and fees, resulting from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.
17. Pre-Departure Documentation
It is important that you carefully read all tour-related documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within 5 days of your receipt of those documents. This agreement, our release and waiver of liability and assumption of risk and indemnity agreement, and, if required, a medical statement or certification must be signed and submitted by you. If you fail to submit these or other necessary documentation prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.
18. Arrival and Departure Transfers
On all Detours With Durso itineraries, you will find recommended times and locations for arrival and departure to and from your tour. In the event your train, flight or other travel falls outside the recommended departure or arrival time or location, you may be responsible for extra costs incurred in arranging a separate transfer to meet the group.
19. Airline Delays, Modification & Cancellations
Detours With Durso is not liable for mistakes or errors in airfare bookings made by the traveler or any independent third parties. We will provide detailed tour arrival and departure requirements via email once the traveler is confirmed. It is up to the traveler to ensure the correct arrival and departure flights from the tour start and end cities, and to check all flight information before departure in case there are any delays, gate changes or cancellations.
Detours With Durso may, for certain tours, arrange mid-tour airline transportation. We will inform you of the carrier(s) as soon as practicable and provide ticketing information. You should check your tickets carefully immediately upon receipt to confirm that your personal identification information is correct and note the flight times. You must notify us immediately upon receipt of any errors in names, dates and timing on your tickets. If flight times change after tickets have been issued, we will notify you as soon as practicable. It is your responsibility to timely join the tour group for transportation to the airport, and all such tour group transportation will depart promptly as scheduled. We cannot accept liability for any delay resulting from your failure to timely join the tour group for transportation to the airport, or for failing to check in or board on time.
In addition, you are responsible for adhering to baggage allowances and other airline-specific guidelines. Any airline charges are your financial responsibility.
Detours With Durso is not responsible for any change to airline schedules or flight numbers or for any additional expenses or loss that may arise from airlines strikes and/or airline, airport, or weather delays. Neither is Detours With Durso responsible if you or any member of your party misses your flight or other transportation arrangements, it is cancelled, or you are subject to a significant travel delay. In any such event, you must notify us as soon as practicable; however, Detours With Durso will not reimburse travelers for any additional expenses incurred as a result of such events or delays.
20. Travel Insurance
International Travel: Adequate travel insurance is mandatory for international tours and is a condition of your contract with us. Travel insurance should be purchased at the time of booking from a company of your choice.
Your travel insurance must provide coverage against personal accident, death, medical expenses and emergency evacuation, with a recommended minimum coverage of US$200,000 for each of these categories. We also strongly recommend that your travel insurance covers cancellation, curtailment, personal liability, loss of luggage and personal effects, evacuation, and repatriation. Further, we recommend that you ensure that there are no exclusion clauses limiting or excluding production for the type of activities included in your tour. You should satisfy yourself that the travel insurance you purchase meets your particular requirements and should arrange supplementary insurance if you believe it necessary to do so.
You must provide proof of your travel insurance at least two weeks prior to your tour start date via email info@detourswithdurso.com. If you fail to provide proof of travel insurance by the travel start date, you will not be allowed to join the tour. Detours With Durso will not provide a full or partial refund for any cancellations or delays resulting from missing proof of travel insurance.
Domestic Travel: For domestic travel within the United States, travel insurance is strongly recommended. If you elect not to secure travel insurance for a domestic tour, you do so solely at your own risk and Detours With Durso assumes no liability for loss relating thereto.
21. Claims & Complaints
We make every effort to ensure that your tour arrangements run smoothly. If you have a complaint about your tour, you agree to inform the tour leader immediately so that we can attempt to address your complaint. If your complaint is not resolved locally, please contact us via email at info@detourswithdurso.com. Detours With Durso assumes no liability for complaints that are not properly brought to the attention of the tour leader or us with sufficient notice to resolve or attempt to resolve complaints.
Any complaint made after the completion of a tour must be received via email within 15 days from the end of the tour, giving your booking reference and all other relevant information. Please keep your email concise and to the point. This will assist us to quickly investigate your concerns and allow us to properly respond to you. Please note that failure to follow the procedure set out in this clause may affect ours and the applicable supplier’s ability to investigate your complaint, and will affect your fights under this contract. You acknowledge and agree that Detours With Durso has no obligation to respond to or address any claims received after this specified 15-day period.
22. Our Authority On Tours & Traveler Responsibilities
Detours With Durso tours are run by a tour leader. You agree that the tour leader’s decision is final on all matters likely to affect the safety or well-being of any person participating in the tour. You may be excluded from all or part of the tour, without refund or recompense, if: (a) your health or level of fitness is endangering or appears likely to endanger your health or well-being, or the health or well-being of any third party (including but not limited to other travelers participating in the tour); or (b) your conduct at any time before or during the tour appears likely to affect or impede the safe, comfortable or pleasant progress of the tour. This decision is in the sole discretion of any tour leader or other person in a position of authority (such as a hotel manager, guide, or other third-party supplier or activity provider).
If you fail to comply with a decision made by a tour leader, or interfere with the well-being or mobility of the group, the tour leader may direct you to leave the tour immediately, with no right of refund and we will have no further responsibility towards you (including any return travel arrangements). We may also elect not to include you on any future tour, even if already booked. In addition, you agree to comply with the laws, customs, foreign exchange, and drug regulations of all countries visited, as well as in accordance with our responsible travel guidelines.
Any travelers who take part in racist, offensive or abusive conduct, sexual harassment, or any other form of discriminatory behavior toward other tour participants, the tour leader, or to any third party will be immediately excluded from the tour, in our complete and sole discretion, and will receive no refund for any missed services or accommodation (as further described above).
When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be made directly to the accommodation owner or other supplier, or to us, as soon as possible. You should ensure that you have appropriate travel insurance to protect you if this situation arises.
23. Release of Liability & Limitation of Remedies
Detours With Durso is not liable for bodily injury or property damage as a result of (but not limited to): physical exertion for which you are not prepared; forces of nature; travel by plane, train, auto, boat, or other conveyance, or by bicycle, ski, horseback, foot, or other form of active travel; consumption of alcoholic beverages; civil unrest; terrorism; breakdown of equipment; high altitude; lack of or limited access to medical attention in remote locations or the adequacy of medical attention once provided.
Travelers who fail to provide a signed Release of Liability before departure will not be permitted to join the tour and a standard cancellation policy will apply.
You agree that the sole remedy for any default by Detours With Durso arising under this agreement shall be the return of the paid tour cost, to the extent consistent with applicable law. To the maximum extent permitted under applicable law, Detours With Durso shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Detours With Durso has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.
Detours With Durso is not responsible for loss of passports, tickets or other documentation, or loss of or damage to luggage, personal property, or other passenger belongings. Given the nature of some tours, you may not always have your luggage with you. Therefore, we urge you to pack carefully, keeping your passport and valuables on your person at all times, and consider leaving valuables at home.
24. Successors & Assigns
This agreement shall inure to the benefit of and be binding upon Detours With Durso and you and your respective heirs, legal and personal representatives, successors and assigns.
25. Severability
If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable, and which achieves, to the extent possible, the original objectives and intent of the original provision.
26. Images Release & Marketing
You agree that Detours With Durso may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides, tour leaders and/or other travelers of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the tour, you must inform us or your tour leader in writing before the start of the tour.
27. Applicable Law
All Detours With Durso tours, bookings and reservations (including but not limited to those made online), policies, and terms and conditions are subject to the laws of the State of California, and all travelers submit to the exclusive jurisdiction of the state and federal courts located in San Diego, California, United States for the resolution of any dispute under these booking conditions, all terms and conditions referenced or incorporated herein, or otherwise concerning Detours With Durso.
28. Amendments to Terms & Conditions
Detours With Durso reserves the right to update and/or alter these terms and conditions at any time, and shall post the amended terms and conditions on the Detours With Durso website. Any such amendment shall take effect 7 days following its posting to the Detours With Durso website. The latest terms and conditions, as amended, may be accessed any time on Detours With Durso website, and can be sent upon their written request via email to info@detourswithdurso.com. All travelers and Detours With Durso customers shall be deemed to have accepted any amendments to these terms and conditions on the date that is 7 days after their posting on the Detours With Durso website.
None of our contractors or service providers have the authority to vary or omit any of these terms. No promise of a discount or refund will be binding on us unless confirmed by us in writing.
29. Refusal of Service
Detours With Durso retains the right to refuse service to any traveler or potential client at any time, for any lawful reason, in its sole discretion.
30. Merger
This agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.
I have read this entire agreement and I understand that this is a legally binding contract. No other representations concerning the legal effect of this document have been made to me.
Traveler’s Code

I have chosen a trip that suits my abilities, fitness level, and state of health and wellness.

I do not have any physical conditions or disabilities that are or could present a hazard to me or other travelers.

I have a valid passport and all visas, permits, certificates and vaccinations required for travel.

I have read any and all pre-trip materials about clothing, medical requirements and culture-specific etiquette.

I will make sure to communicate any special requests at least 30 days before travel. This includes dietary restrictions, medical requirements and room preferences. I understand that Detours With Durso will make every effort to accommodate special requests but cannot guarantee they will be met.

I will respect the laws and customs of countries visited.

I will follow environmental guidelines and regulations while on the tour in accordance with the tour leader’s direction.

I will respect the rights and privacy of fellow travelers, and I will be respectful towards all persons I encounter on the tour (including but not limited to fellow travelers).

I understand that group travel invariably involves compromise to accommodate the diverse desires, travel goals, personalities, and physical abilities of all group members. Detours With Durso tour leaders may be required to improvise and exercise good faith, use discretion and/or make decisions based upon group consensus. These decisions may not always please each individual but are intended to satisfy the larger desires of the group.

I understand that Detours With Durso reserves the right to refuse service during a tour to anyone whose health and/or behavior could impede the welfare or enjoyment of fellow travelers. An individual may be asked to leave a trip if the tour leader determines that the person’s continuing participation may prove detrimental to the individual or the group.

I understand that in some instances access to medical facilities and evacuation services may be limited.

I understand that the weather is beyond Detours With Durso’s control.

I will consume alcohol responsibly.

I will be responsible for any and all damages made to a hotel room.
If you do not consent to these rules, you risk dismissal from the tour and returning home at your expense with no refund for the missed tour portion. Detours With Durso reserves the right to decline or cancel a reservation should the individual’s health or behavior impede the welfare or enjoyment of fellow travelers.
